本規約は、A&Mグループ株式会社（以下「当社」）が提供する Android アプリケーション「EarEffect」（以下「本アプリ」）の利用条件を定めるものです。本アプリをご利用いただくことで、本規約に同意したものとみなします。
1. 本アプリでできること
本アプリは、端末が出力している音に対して音質調整を行います。本アプリ自体は音楽を再生しません。 他のアプリが鳴らしている音を整えるものです。
再生中の曲名とアーティスト名から音楽のジャンルを判別し、それに合う設定を選ぶ機能を備えています。判別は完全ではなく、意図と異なる結果になることがあります。その場合は手動で選び直せます。
2. 必要な許可
曲名の取得には通知アクセスの許可が必要です。音量メーターの表示にはマイク権限を使用しますが、録音は行いません。詳細はプライバシーポリシーをご確認ください。
いずれの許可も任意です。許可しない場合、該当する機能が動作しないだけで、音質調整そのものはご利用いただけます。
3. 有料プラン
本アプリの一部機能は、有料プラン（サブスクリプション）でご利用いただけます。購入手続き、決済、解約、払い戻しは、すべて Google Play を通じて行われます。当社が決済情報を取得することはありません。
解約は Google Play ストアの「定期購入」からお手続きください。解約後も、支払い済みの期間が終わるまではご利用いただけます。
価格は国および為替により異なります。改定する場合は、Google Play の定めに従い事前にお知らせします。
4. 音量と聴覚について
大きな音量での長時間の使用は、聴覚を損なうおそれがあります。 本アプリは音質を変えるものであり、安全な音量を保証するものではありません。音量は適切に管理してください。
本アプリは補聴器ではなく、医療機器でもありません。聴力に関する不安がある場合は、医師にご相談ください。
5. 禁止事項
- 本アプリの改変、逆コンパイル、逆アセンブル
- プリセットデータの抽出、複製、再配布
- 本アプリまたはその一部を、当社の許諾なく販売、貸与、再配布すること
- 法令または公序良俗に反する目的での使用
6. 知的財産
本アプリ、プリセットデータ、意匠、ロゴ、その他一切の権利は当社に帰属します。本アプリの利用は、これらの権利の移転を意味しません。
7. 免責
本アプリは現状有姿で提供されます。当社は、本アプリが利用者の特定の目的に適合すること、中断なく動作すること、および不具合がないことを保証しません。
端末、OS、再生アプリの仕様変更により、機能が動作しなくなる場合があります。
当社は、本アプリの利用によって生じた損害について、当社に故意または重大な過失がある場合を除き、責任を負いません。責任を負う場合であっても、その範囲は利用者が直近12か月間に当社へ支払った金額を上限とします。
8. 提供の中止
当社は、事前の通知なく本アプリの提供内容を変更し、または提供を中止することがあります。
9. 本規約の変更
当社は本規約を改定することがあります。重要な変更を行う場合は、本ページに掲載するとともに本アプリ内でお知らせします。改定後も本アプリを利用された場合、変更に同意したものとみなします。
10. 準拠法および管轄
本規約は日本法に準拠します。本アプリに関して紛争が生じた場合、千葉地方裁判所を第一審の専属的合意管轄裁判所とします。

These terms govern your use of the Android application EarEffect ("the app"), provided by A&M Group Inc. ("we"). Using the app means you accept them.
1. What the app does
The app adjusts the sound your device is already producing. It does not play music itself — it shapes what another app is playing.
It works out the genre from the track title and artist, and picks a setting to match. That judgement is not perfect and will sometimes land somewhere you did not intend; you can choose again by hand whenever it does.
2. Permissions
Reading the track requires notification access. Drawing the level meter uses the microphone permission, but nothing is recorded. See the Privacy Policy.
Both are optional. Decline either and only that feature stops; the sound adjustment itself continues to work.
3. Paid features
Some features are available on a paid subscription. Purchase, payment, cancellation and refunds are handled entirely by Google Play. We never receive your payment details.
Cancel through Subscriptions in the Google Play Store. Access continues until the end of the period you have paid for.
Prices vary by country and exchange rate. Any change will be notified in advance in accordance with Google Play's rules.
4. Volume and hearing
Listening loudly for long periods can damage your hearing. The app changes how sound is shaped; it does not guarantee a safe volume. Please manage the volume yourself.
The app is not a hearing aid and is not a medical device. If you have concerns about your hearing, consult a doctor.
5. What you may not do
- Modify, decompile or disassemble the app
- Extract, copy or redistribute the preset data
- Sell, lend or redistribute the app or any part of it without our permission
- Use it for any unlawful purpose
6. Intellectual property
The app, its preset data, design, logo and every other right in it belong to us. Using the app transfers none of them.
7. No warranty
The app is provided as it is. We do not warrant that it suits any particular purpose, that it will run without interruption, or that it is free of faults.
Changes to your device, to Android, or to the app playing the music may stop a feature working.
We are not liable for loss arising from use of the app, except where we have acted with intent or gross negligence. Where we are liable, our liability is limited to the amount you paid us in the preceding twelve months.
8. Withdrawal
We may change what the app offers, or stop offering it, without prior notice.
9. Changes to these terms
We may revise these terms. Where a change is significant we will post it here and say so within the app. Continuing to use the app after that means you accept the revision.
10. Governing law
These terms are governed by the law of Japan. The Chiba District Court has exclusive jurisdiction at first instance over any dispute concerning the app.
